These Terms and Conditions (“Terms”) govern your use of the Designs by JT website and any graphic design, printing, production, creative, or related products and services provided by Designs by JT (“Designs by JT,” “we,” “our,” or “us”).

By using our website, requesting a quote, submitting materials, placing an order, making a payment, approving a design, or otherwise using our services, you acknowledge and agree to these Terms and Conditions.

Designs by JT provides graphic design, printing, production, and related creative services, including but not limited to:

Flyers • Posters • Pamphlets • Brochures • Obituaries & Memorial Programs • Business Materials • Event Materials • Custom Graphics • Easels • Displays • Printing Supplies • Other Custom Printed Products

Services, products, prices, availability, production methods, and turnaround times may change according to the requirements of individual projects.

Designs by JT reserves the right to modify, discontinue, refuse, or cancel a service or order when reasonably necessary.

Customers are responsible for providing accurate information when requesting a quote or placing an order.

Prices displayed on our website or promotional materials may represent starting or base prices. Final pricing may vary according to quantity, dimensions, materials, paper stock, printing method, design complexity, finishing, mounting, hardware, delivery, production requirements, turnaround time, and other specifications.

Large-volume, commercial, organizational, campaign, event, and recurring orders may require custom pricing.

A quote does not necessarily constitute a final agreement until the customer accepts the quote and any required payment or deposit has been received.

Designs by JT may require partial or full payment before beginning design or production.

We reserve the right to correct pricing, description, typographical, or calculation errors before an order is finalized.

Customers agree to provide accurate, complete, and reasonably current information, files, photographs, logos, text, artwork, specifications, and instructions necessary to complete their projects.

Customers are responsible for ensuring that they have the legal rights, licenses, authorization, or permission necessary to use and reproduce materials they provide to Designs by JT.

This includes, where applicable:

• Photographs
• Logos
• Trademarks
• Copyrighted materials
• Written content
• Artwork
• Images
• Names and likenesses
• Business materials
• Other intellectual property

The customer remains responsible for the content they request Designs by JT to reproduce, print, or incorporate into a project.

Design proofs or previews may be provided to customers for review and approval.

Customers are responsible for carefully reviewing all information before approving a final design, including:

• Names
• Dates
• Times
• Addresses
• Telephone numbers
• Prices
• Spelling
• Grammar
• Photographs
• Colors
• Layout
• Event information
• Other important details

Once a customer approves a design for production, Designs by JT is not responsible for errors that were visible in the approved proof but were not identified by the customer.

Changes or revisions requested after final approval may result in additional design, printing, or production charges.

Excessive revisions or changes beyond the originally agreed scope of work may also result in additional charges.

Production and delivery dates are estimates unless Designs by JT expressly agrees otherwise in writing.

Production or delivery may occasionally be affected by circumstances outside our reasonable control, including supplier delays, equipment problems, shipping delays, weather, shortages, technical difficulties, or other unforeseen circumstances.

Designs by JT will make reasonable efforts to complete orders according to agreed schedules but cannot guarantee circumstances beyond our control.

Shipping, delivery, installation, and pickup charges may be assessed separately depending upon the order.

Orders may be canceled before design or production work begins, subject to the specific terms of the customer's order.

Once custom design work has begun, compensation may be due for work already performed.

Deposits may be designated as non-refundable when disclosed as part of the order agreement.

Once printing, manufacturing, customization, or production has begun, an order generally cannot be canceled or refunded unless Designs by JT agrees otherwise.

Because many Designs by JT products are personalized or custom-made, completed customized products generally cannot be returned merely because a customer changes their mind.

If Designs by JT makes a material production error or delivers a defective product, customers should contact us promptly so that we can review the issue and determine an appropriate resolution.

Original designs, concepts, drafts, layouts, artwork, templates, and other creative materials produced by Designs by JT remain the intellectual property of Designs by JT until applicable payment obligations have been satisfied, unless otherwise agreed in writing.

Upon full payment, the customer generally receives the right to use the final approved product for its intended purpose, subject to any separately agreed licensing terms and any third-party intellectual property incorporated into the project.

Drafts, unused concepts, source files, working files, templates, and preliminary designs are not automatically transferred to the customer unless specifically included in the agreement.

Designs by JT will respect client confidentiality and will not publicly identify a customer as a Designs by JT client or publicly display a client's project, name, logo, testimonial, or identifying information for promotional purposes without the client's permission.

Your business is your business.

Designs by JT respects the privacy and confidentiality of our customers.

We do not sell, rent, trade, or provide customers' personal information to third parties for their independent advertising, marketing, solicitation, or commercial purposes.

We also consider the identity of our clients confidential.

Designs by JT will not publicly disclose, publish, advertise, confirm, or otherwise identify an individual, company, organization, or other entity as a Designs by JT client without that client's consent.

Customer photographs, documents, communications, graphics, business information, memorial materials, and other files are treated with discretion and used as reasonably necessary to provide the requested services.

Information may be provided to limited service providers when reasonably necessary to fulfill an order, such as payment processors, printing providers, shipping companies, website providers, or technology providers.

Information may also be disclosed where required by applicable law, valid court order, subpoena, or other legally binding process.

Designs by JT serves a broad and diverse clientele.

We understand that individuals, businesses, movements, organizations, campaigns, and communities may hold ideas, messages, viewpoints, or positions that others consider controversial or politically incorrect.

Designs by JT supports freedom of expression and operates with a strong commitment to First Amendment principles.

We welcome customers whose lawful ideas, messages, graphics, or materials may have been rejected by other design or printing providers because of their viewpoint or subject matter.

However, Designs by JT reserves the right to refuse any project that we reasonably believe would require us to violate applicable law or expose our business, employees, contractors, or customers to unlawful conduct or substantial legal risk.

Acceptance of a printing or design project does not necessarily constitute endorsement by Designs by JT of the customer's views, organization, message, ideology, or activities.

Customers may not use our website or services to engage in unlawful conduct or knowingly request Designs by JT to produce materials that violate applicable law.

Customers may not knowingly use our website to:

• Commit fraud
• Introduce malicious software
• Attempt unauthorized access to computer systems
• Impersonate another person for fraudulent purposes
• Violate another person's intellectual-property rights
• Engage in unlawful threats or harassment
• Send unauthorized spam through our systems
• Interfere with the operation or security of our website

Designs by JT may refuse service or restrict website access when reasonably necessary to protect our business, customers, systems, or legal rights.

We attempt to keep information on our website accurate and reasonably current.

However, Designs by JT does not guarantee that every website description, price, photograph, availability statement, or other piece of information will always be completely accurate or current.

Website access may occasionally be interrupted by maintenance, technical problems, hosting issues, upgrades, or circumstances beyond our control.

We reserve the right to correct errors and update website information.

To the extent permitted by applicable law, Designs by JT will not be responsible for indirect, incidental, special, or consequential damages resulting from the use of our website, services, or products.

Where permitted by law, Designs by JT's total liability arising from a particular paid service or order will not exceed the amount actually paid to Designs by JT for the service or order giving rise to the claim.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

To the extent permitted by law, customers agree to be responsible for claims, damages, losses, or expenses arising from materials they provide to Designs by JT when those materials violate another person's copyright, trademark, privacy, publicity, or other legal rights.

This provision does not apply to claims resulting solely from the independent wrongdoing or negligence of Designs by JT where liability cannot lawfully be shifted.

Designs by JT may use third-party providers for services such as payment processing, website hosting, printing, production, shipping, delivery, analytics, communications, or technology.

Third-party providers may have their own terms, privacy policies, warranties, and operating procedures.

Designs by JT is not responsible for independent acts or policies of third-party providers beyond the extent required by applicable law.

Designs by JT reserves the right to refuse, suspend, or terminate services when reasonably necessary, including for:

• Nonpayment
• Fraud or suspected fraud
• Material violation of these Terms
• Abuse of our website or systems
• Unlawful activity
• Intellectual-property violations
• Threats toward staff or customers
• Attempts to misuse our services
• Other circumstances presenting substantial legal or security concerns

Where appropriate, customers remain responsible for authorized work completed before cancellation or termination.

Designs by JT may revise these Terms and Conditions periodically to reflect changes in our business, website, products, services, or legal requirements.

Updated Terms may be posted on our website with a revised effective date.

Continued use of our website or services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
